Terms of Service
These Terms of Service ("Terms") govern the rights, obligations, and responsibilities between Abear ("Company") and users ("Members") in connection with the use of the Pervis service ("Service").
1. Purpose
These Terms set forth the conditions for using "Pervis," a digital performance advertising management service, and define the rights, obligations, and responsibilities of the Company and Members.
2. Definitions
- "Service" means the Pervis web application, software, and related features provided by the Company.
- "Member" means a person who agrees to these Terms and creates an account in accordance with the Company's procedures.
- "Account" means the login credentials, including email and password, registered by a Member.
- "Advertising Platform" means third-party digital advertising platforms such as Meta and Google.
3. Effect and Modification of Terms
- These Terms become effective when posted on the Service and accepted by the Member.
- The Company may modify these Terms to the extent permitted by applicable law.
- Changes and the effective date will be announced in advance through the Service.
- Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
4. Governing Rules
- Matters not specified in these Terms are governed by applicable laws and general commercial practices.
- The Company's Privacy Policy governs the collection and processing of personal information.
5. Account Registration and Management
- Users must agree to these Terms and the Privacy Policy and complete the registration process to use the Service.
- The Company may refuse registration if:
- False or stolen identity information is used
- False information is provided
- The application violates applicable laws or Company policies
- Members must update their account information without delay if it changes.
- Members are responsible for managing their accounts and passwords and may not transfer or share them.
6. Personal Data and External Account Integration
- The Company collects and uses personal information only as necessary to provide the Service, in accordance with the Privacy Policy.
- When a Member connects an Advertising Platform account, the Company accesses and uses such data only within the scope of the Member's consent.
- Members are responsible for complying with the terms and policies of each Advertising Platform.
- When a Member connects a Google account, the Company accesses Google Ads data and Google Drive, Sheets, and Slides files only within the scope authorized by the Member, and uses them solely to operate advertising and generate performance reports.
- The Company's use and transfer of Google user data adheres to the Google API Services User Data Policy, including the Limited Use requirements; further details are described in the Company's Privacy Policy.
7. Service Provision and Changes
- The Service includes:
- Integrated management of campaigns, ad sets, and ads
- Synchronization with external Advertising Platforms
- Validation, error detection, and notification features
- The Company may modify or discontinue part or all of the Service for operational or technical reasons, with prior notice for material changes.
- The Service is currently provided free of charge. The Company may introduce paid plans in the future with prior notice and consent.
8. User Obligations and Prohibited Activities
Members must not:
- Use another person's account or payment information
- Interfere with the operation of the Service or Advertising Platforms
- Infringe intellectual property, privacy, or other rights
- Reverse engineer, decompile, or disassemble the Service
- Support or promote advertising activities that violate laws or platform policies
- Engage in unlawful or inappropriate conduct as reasonably determined by the Company
9. Service Suspension
- The Company may temporarily suspend the Service due to:
- Maintenance or system upgrades
- Network failures, power outages, or force majeure
- Planned suspensions will be announced in advance when possible.
10. Intellectual Property
- All intellectual property related to the Service belongs to the Company or its licensors.
- Members may not copy, modify, distribute, sell, or create derivative works without prior written consent.
- Data and content provided by Members remain their property, but the Company may process and analyze them to operate and improve the Service, in accordance with the Privacy Policy.
11. Termination
- Members may terminate their account at any time through the Service.
- The Company may suspend or terminate access if a Member violates these Terms or applicable laws, after notice and opportunity to cure where reasonable.
- In urgent cases, the Company may suspend access immediately and notify the Member afterward.
12. Limitation of Liability
- The Company is not liable for service disruptions caused by events beyond its reasonable control, including natural disasters, cyberattacks, or network failures.
- The Company is not responsible for issues caused by the Member's fault.
- The Company is not responsible for disputes between Members and Advertising Platforms or among Members.
13. Governing Law and Jurisdiction
- The Company and Members will attempt to resolve disputes through good-faith consultation.
- These Terms are governed by the laws of the Republic of Korea, and the competent court under the Civil Procedure Act shall have exclusive jurisdiction.
